FDA Agent Pro Scope of Services and Terms and Conditions Service: Food & Beverage FDA Facility Registration
Submitter or operator/owner of the food and/or beverage facility is hereinafter referred to as “Client.”
1. Client shall provide FDA Agent Pro with all information, materials, and others necessary or reasonably requested by FDA Agent Pro to fulfill U.S. Agent's responsibility as a registered agent and official correspondent pursuant to the FDA Regulations.
2. The scope of U.S. Agent services does not include any other regulatory consulting services.
3. The purpose of the U.S. agent is to act as a medium of communication for the FDA to communicate with food and/or beverage facility. The submitter/food facility warrants that the facilities information and materials will be accurate, truthful, genuine, and current.
4. Client acknowledges that FDA Agent Pro is acting as a U.S. Agent between the food facility and the Food and Drug Administration and has no involvement or specific knowledge of the products manufactured/distributed by the food facility. The client not hold FDA Agent Pro liable for any negligence and/or damages whatsoever, including but not limited to any liability arising with respect to the performance of the product manufactured/distributed at the facility.
5. FDA Agent Pro shall not be held responsible for breach of contract caused by an act of God, insurrection, civil war, military patio, or local emergency, or by any act or failure to act by the U.S. Food and Drug Administration.
6. Client authorizes FDA Agent Pro to update /modify the food facility registration.
7.Client shall keep updated about any change in the facility address or ownership.
8. Client agrees not to use U.S. Agent services for multiple facilities.
9. Client shall not use the U.S. Agent's DUNS number for FSVP importer identification purposes.
10. Validity –
If paid, $309 – One year from the date of invoice or initial registration, whichever is earlier
If paid, $559 – Two years from the date of the invoice or initial registration, whichever is earlier
The fee is non-refundable. FDA Agent Pro shall cancel the registration in the event of failure to renew US agent contract.
11. The US Agent services is limited to food facility registration of the client name mentioned in the invoice.
12. Client understands that food facility registration is one of the requirements for selling food product in the USA, and agree to comply other regulatory requirements.
13. DUNS number is mandatory for food facility registration. Failure to provide DUNS within 60 days may result in the food facility registration cancellation.
14. Client must NOT use FDA Agent Pro or associated companies as an FSVP agent without a valid FSVP agent contract.
15. Client agrees to assume all risk, release FDA Agent Pro LLC officers, directors, employees, affiliates, and agents from any and all liability in connection with this product and its listing, waive all claims and will hold harmless and indemnify FDA Agent Pro LLC and its officers, directors, employees, affiliates, and agents from any and all claims in connection with this product, its marketing, labeling or listing with FDA. 16. Client confirms that he/she has authorization from the operator/owner of the facility to submit the food facility registration.
